- Photo comes from the subject's Facebook page - https://www.facebook.com/pages/Anup-Sridhar/10110016673 - where he has lots of other photos of himself at this same event (meaning they did not copy the photo from here). It appears that this photo was uploaded here the same day it was uploaded to Facebook meaning that it's least possible that the uploader is, in fact, working for the copyright holder. But there needs to be some sort of confirmation of the license. B (talk) 02:50, 9 April 2013 (UTC)[reply]
- I suggest to change the license to {non-free fair use in|Anup Sridhar|image has rationale=yes}. --Florentyna (talk) 04:06, 9 April 2013 (UTC)[reply]
- Umm, no. We do not accept photos of living people used under a claim of fair use. Please see WP:NFCC#1. --B (talk) 12:08, 9 April 2013 (UTC)[reply]
- I found it on Flickr - © all rights reserved. Pre-dates our upload by two months. -- Dianna (talk) 21:57, 17 April 2013 (UTC)[reply]

- Per point #3 of http://mailer.fsu.edu/~akirk/tanks/disclaimer.htm, this license seems highly questionable. The source website basically says that they are not the author of a lot of these photos. B (talk) 04:57, 9 April 2013 (UTC)[reply]

The result of the discussion was: Delete all; as uploader does not seem to still be active here, it doesn't seem as though we are likely to get any confirmation of ownership here. (ESkog)(Talk) 12:31, 21 May 2013 (UTC)[reply]
- File:Titi Kwan Paris 2.jpg (delete | talk | history | logs).
- What concerns me about this is that it is exactly the same picture as on Titi Kwan's official website (see http://www.titikwan.fr/HomemadeFairies/01.html) and there isn't really a convincing claim of authorship made by the uploader/creator. It is obviously a very professional photograph, and I'd expect the photographer to give more details/identify themselves for the publicity. Mabalu (talk) 17:13, 9 April 2013 (UTC)[reply]
- Comment - However, I think there is some benefit of the doubt to be given - another of their uploads, File:Titi kwan paris 1.jpg also appears on the website at http://www.titikwan.fr/HomemadeFairies/12_13.html - and it's a different sized picture with no immediate sign of having been resized up from a screengrab. I think the uploader deserves a chance to confirm (and prove) that they hold copyright to these images and are happy for us to use them. If no proof of ownership is forthcoming, we should probably consider deleting files File:Titi kwan paris 1.jpg, File:Titi Kwan showcase on LC.jpg, File:Titi Kwan Paris 2.jpg, File:Alibellus+ AW12 Women.jpg, and File:Alibellus+ AW12 Men Collection.jpg too. Mabalu (talk) 17:21, 9 April 2013 (UTC)[reply]
- Also, take a look at File:Titi Kwan's styling for Faye Wong concert 2011 1.jpg and File:Titi Kwan styling for Faye Wong concert 2.jpg - it's not beyond the realm of possibility that these are pictures taken by the uploader if he/she attended the concert, but they do look a bit disconcertingly professional too. The result of the discussion was: Non-free but kept (at least for now); I don't know precisely how to formulate the use rationale, but as noted below it is probably a legitimate use per the NFCC. Uploader remains active, and can likely help with this. (ESkog)(Talk) 13:33, 22 May 2013 (UTC)[reply]

- Keep one way or the other - Loathe as I am to come down on the pro-fair-use side of anything, this one seems to be used transformatively and is legitimate fair use. But also, is there a reasonable circumstance where the car would be public domain in the US, even if it is copyrighted in France (and thus eligible for use on Wikipedia even though Commons would reject it)? This car was made in 1958 in France. --B (talk) 19:04, 17 April 2013 (UTC)[reply]
- The uploader said on my talk page that they were offered for sale in the United States pre-1978. If it can be demonstrated that there is no copyright notice, we should be golden on Wikipedia (even if not on Commons), right? --B (talk) 21:32, 17 April 2013 (UTC)[reply]
- Not if the same car model was offered for sale in France more than 30 days before it was offered for sale in the United States. I don't know whether a copyright notice on the packaging would be enough, and we don't know anything about what's hidden on the packaging. --Stefan2 (talk) 00:14, 18 April 2013 (UTC)[reply]
