Casum sentit dominus
- ... that Latin legal maxims like casum sentit dominus have been described as "guardians of eternity [...] more lasting than codifications"? Source: Wacke, Andreas (1987). "Casum sentit dominus: Liability for Accidental Damages in Roman and Modern German Law of Property and Obligation". Journal of South African Law. 1987 (3): 318–331. ISSN 0257-7747. The relevant passage reads:"So the Roman rules of law dealt with here have sustained their lasting vivacity also within codified continental European law. Furthermore, we are surprised by the coincidence in difficult questions of liability (especially the distinction between ordinary liability after litispendence and stricter liability in default), the founding stone of which was laid by the Romans even before the birth of Christ.74 Latin law maxims or 'Brocardica' are more lasting than codifications, they remain the guardians of eternity which the statutes have abandoned ([...]). 75 Fur semper in mora means more to us than the plain number of a paragraph in a statute76 because even the Latin wording makes the norm stand out from the usual legal language and makes it easier to memorize."
