This image belongs to Backstage Press, and I have included a fair-use rationale for using this non-free image. It is a book cover. Which tag should I have used? I would like to keep this image help identify the product in the associated article, but also wish to do it properly.Ukulele 06:20, 17 October 2007 (UTC)
Backstage Press is not asserted to be the source of this image when it was uploaded; it is derived from the site of ABCdaire des Jeux de Rôle. This image should be deleted and a new image and licence obtained rom Backstage Press. --Gavin Collins 08:15, 17 October 2007 (UTC)
- Are you disputing the fair-use rationale? Can not a copyrighted image be used if it falls under the guidelines for fair-use? Ukulele 14:44, 17 October 2007 (UTC)
- Not if the source forbids it, as is clear in this case. --Gavin Collins 14:57, 17 October 2007 (UTC)
- Part of the statement you refer to seems to translate to:
- All role-playing cited in the site, their names, their logos, their supplements are the property of their respective editor.
- This appears to indicate that the site where the image originates does not claim ownership or copyright of this image. I believe fair-use is satisfied here as I can find no statement by Backstage Press that this image is forbidden to be used. I would greatly appreciate it if you could point me to the policy you are referring to. I am getting a bit lost in the mass of articles about non-free image use. Thanks. - What does the first part of the copy right statement say? Forgive my French, but I think it translates as: "Any use of the contents of this site is not allowed without prior authorisation." I don't think you have such authorisation, but you could get it. --Gavin Collins 15:57, 17 October 2007 (UTC)
- I believe we are circling each other's argument here. I believe you are making a technical point that because the website where the image was taken has blanket statement attempting to protect all it's content from reproduction, fair-use of the image is not possible. Can you please point me to the Wikipedia policy that supports this? Copyright protection does not extend to proper fair-use. Once again, I am honestly asking you to point me the particular article (and paragraph if possible) of the Wikipedia policy upon which you are basing your argument. Were I to acquiesce to this RFD and simply upload a scanned image, would you then request deletion of this image based on other grounds? Ukulele 17:59, 17 October 2007 (UTC)
