I (Martin_Hinks) assert that use of this image within the Syntax (band) article on Wikipedia is fair use under US law for the following reasons:
- It was commissioned by Syntax to promote them and their work;
- Use of the image in low resolution does not harm or prejudice the rights of the copyright owner;
- No free image which suitably illustrates Syntax has been found;
- The Syntax article would suffer greatly if no image of the band were featured in the lead.
This work is copyrighted (or assumed to be copyrighted) and unlicensed.
