- It is a low resolution copy of a promotional photograph;
- It does not limit the copyright owner's rights to distribute the photograph in any way;
- No free alternative photographs can be found since the person in question is deceased;
- The deceased band member died while the group was on tour, and was a media talking point for awhile;
- Scanned copies could not be used to make illegal copies of the photograph.
